Yes. Risk assessment is mandatory for all employers, regardless of the number of employees or activity. The employer must ensure that a risk assessment is prepared and regularly updated in accordance with the Law on Occupational Safety and Health (“Official Gazette of RS”, No. 35/2023).
The employer is obliged to ensure that work in the field of OSH is performed by an expert – whether he is employed by the employer or through a contract with a licensed OSH agency. This also applies to businesses with one employee.
Yes. Every employee must undergo OSH training before starting work, when changing workplace, technology or working environment. Training is conducted by an authorized person or an agency licensed by the Ministry.
If the workplace does not have an increased risk, the knowledge check is performed at least once every three years, and if necessary, earlier – if there is an injury at work, a change in technology, working conditions or work organization.
Fines for employers are high – from 400,000 to 1,500,000 dinars for legal entities and from 50,000 to 150,000 dinars for responsible persons. The labor inspectorate has the right to prohibit work until the deficiencies are corrected.
